Service Agreement

Monthly Maintenance Service Fee

As of February 1, 2012: all customers must agree to the $30.00 USD per month maintenance fee for a minimum 1 year. After the first year, the service fee is assessed on a month-to-month basis, during which the customer is free to discontinue service at any time. The Monthly Maintenance Service includes the following:

1. Domain Name registration (or transfer)
2. Website Hosting
3. Site Content and Media updates*
4. 24hr Customer Support Website Access
5. Weekly Site Backups

*Customers are provided 1hr of support and updates a month free of additional charges. For all work done after the 1hr the customer will be billed at a rate of $30 per hour of work. There is a 1hr minimum charge. "Updates" include, but are not limited to: text changes, audio/video/photo editing or alterations, & minor design changes. Complete Site redesign or code changes do not qualify.

 

Website Design

Each package includes 1 final website design. After the customer has approved the final design, any graphic design changes to the website — including full site redesign — will be charged the flat rate of $100/hr.

 

Package Upgrades

The customer may upgrade to a higher level website package at anytime during their subscription service. In doing so, the customer agrees to pay the difference in the setup & design fees between the two packages. A site upgrade includes a new site design as well as all features and options available with the new package.

 

Package Downgrades

The customer may downgrade to a lower level website package with a full refund within the first 30 days of service. After 30 days, the downgrade will be considered an early termination. The customer will then be refunded the difference between the two packages, less the early termination fee. The customer has the option to credit the refund to their account.

 

Website Design Ownership

Customers who subscribe to the Emerging Artist or Principal Artist website packages retain full ownership of the website design and all content therein upon the start of service. Customers who subscribe to the Young Artist website package are able to purchase the complete site files for $100.00. The site editor is NOT included with the purchase of the website files.

 

Website Content Ownership

Stephen Brody and/or Inspired Revolutions is not responsible for any of the content on, added, or changed on a customer’s website. The content including text, photos, images, audio files, etc are the sole property and responsibility of the customer.

Email Forwarding and Accounts

Inspired Revolutions may provide email forwarding and account services to it’s customers. If the customer requests an email address “name@yourdomain.com”, Inspired Revolutions is not responsible for any loss of data associated with the email account.

 

Unify® Website Editor

Inspired Revolutions utilizes the third party Unify® software and license for front end website editing. Inspired Revolutions is not responsible for any loss of data due to the editor. Inspired Revolutions will restore the last saved backup of the website within 24hrs. Inspired Revolutions is responsible for the registration and licensing of the Unify® software for each website package.

 

Web Hosting

Stephen Brody/Inspired Revolutions provides web hosting services through a third party company, Site5.com. Web hosting services include unlimited space and bandwidth with 24/7 support through the Site5 company. Since the host company is a third party and is not owned or managed by Stephen Brody, there is no guarantee of 100% live online time. If for any reason the customer’s website experiences downtime due to server issues, Stephen Brody will work with Site5 to return the website to online status as soon as possible. The client has the option to host their website through another company and must provide Stephen Brody with full access to the host account at all times.

 

Termination

Either Party may terminate this Agreement at any time via written notice. If the customer chooses to terminate the agreement prior to the completion of the 1year subscription, the customer is subject to a $150 early termination fee. The customer’s website shall be taken down immediately and the files delivered accordingly.

 

Payment of Fees

In order for Stephen Brody/Inspired Revolutions to remain in business, payments must be made promptly. Delinquent bills will be assessed a $25 charge if payment is not received within 10 days of the due date. If an amount remains delinquent 30 days after its due date, an additional 10% penalty will be added for each month of delinquency. Stephen Brody reserves the right to remove web pages from viewing on the Internet until final payment is made. Refund Policy

The customer has 30 days from the start of service to apply for a full unconditional refund via email or written letter. After 30 days the request will be considered as an early termination and subject to the early termination fee. In receiving a full refund, the customer forfeits all rights to the site design and development performed by Stephen Brody/Inspired Revolutions.
